Terms of service
Last updated: 10 October 2026
Who we are and what these terms cover
These terms are the agreement between you and Passback, operated by a sole trader (trabalhador independente) with NIF and VAT number PT311924093 ("we", "us"), for the hosted Passback service at passback.dev ("the service"). You can be a consumer or a business. By creating an account or using the service you accept these terms.
If you use the service for a company, you confirm that you may bind that company.
The service
Passback lets a website collect comments from people who look at it and sends each comment, with the page, the element and the place in the code, to the issue tracker you choose. The hosted service includes the dashboard, the API and the file storage for screenshots on the plans that include them. The plans and what each includes are described on the pricing page.
The open source parts, such as the widget and the command line tools, are licensed separately under the MIT licence and are not covered by these terms.
Your account
You must give correct information and keep your sign-in secure. You are responsible for what happens under your account. Tell us at support@passback.dev if you think someone else has access.
You must be at least 18 years old, or the age of majority where you live if that is higher.
Free trial
A new account has 14 days free, with no card needed. When the trial ends, the sites you want to keep running need a paid plan. If you do not pay, the service pauses as described under late payment below. We may limit the trial to one per person or company.
Plans, prices and payment
Each site has its own plan. The price of a plan is the price shown on the pricing page and at checkout when you buy it, and you can pay monthly or, where offered, yearly. A yearly plan is paid for the whole year in advance. Prices are shown before tax. We add VAT where the law requires it; businesses in another EU country can give a valid VAT number so that VAT is not charged and the reverse charge applies.
Payment is handled by Stripe. We charge your card or other chosen method at the start of each period. Plans renew automatically until you cancel.
We may change prices. A change applies from the next period after we have told you by email at least 30 days before, and you can cancel before it applies.
Cancelling and refunds
You can cancel at any time in the dashboard or by writing to support@passback.dev. The plan then runs to the end of the period you paid for and does not renew.
Refund: if you ask within 14 days of the first charge for a site, we refund that charge in full. After that, a period already started is not refunded, except where the law requires it.
This refund promise is in addition to any rights you have by law as a consumer, including the right to withdraw from a distance contract. Where a consumer asks that the service starts during the withdrawal period, the consumer may still have to pay for the service already provided if they withdraw, as the law allows.
Late payment and pausing
If a payment fails we keep the service on while Stripe retries and we tell you in the dashboard and by email. If the payment still fails, or a trial ends unpaid, you have a further 7 days. After that the widget is hidden from your visitors and new comments are refused. We do not delete anything when we pause a site. When you pay, the site turns on again at once.
Your content and feedback data
You keep all rights to your content and to the feedback your visitors send. You give us the right to process it only to run the service for you. You are responsible for having the right to collect it, including telling your visitors that you use the widget. For personal data in feedback we are your processor and the data processing agreement at https://passback.dev/legal/dpa/ applies. It is part of these terms.
How we handle your own personal data is in the privacy notice at https://passback.dev/legal/privacy/.
Acceptable use
Do not use the service to break the law, to collect data from people who do not know they are being asked, to attack or overload the service or other people's systems, to try to get around plan limits, or to send malware or abusive content. We may pause an account that does this, after telling you where we can.
Availability and support
We work to keep the service running but we do not promise it will be available all the time or free of errors. We may do maintenance, and we tell you in advance where we can. Support is by email at support@passback.dev.
Our responsibility
Nothing in these terms limits what the law does not allow us to limit, including liability for intent or gross negligence, and your rights as a consumer.
For business customers: we are not liable for lost profit, lost data that you could have backed up or indirect loss, and our total liability for any claim is limited to the fees you paid us in the 12 months before the event.
For consumers: the legal guarantee for digital services applies in full.
Ending the agreement
You can stop using the service at any time and delete your sites and account in the dashboard. We can end the agreement with 30 days' notice, and straight away if you seriously break these terms. If we end it without a breach on your part, we refund the unused part of what you prepaid. After the end we delete your data as described in the privacy notice.
Changes to these terms
We may change these terms. If a change matters to you we tell you by email at least 30 days before it applies, and you can cancel before then. Using the service after that date means you accept the new terms.
Law and disputes
These terms are governed by the law of Portugal. If you are a consumer in the EU you also keep the protection of the mandatory rules of the country where you live.
Consumers can bring a dispute to a consumer dispute resolution body; the list is at https://www.consumidor.gov.pt, for example the Centro de Arbitragem de Conflitos de Consumo de Lisboa at https://www.centroarbitragemlisboa.pt. We have not committed to take part in one specific body. The electronic complaints book is at https://www.livroreclamacoes.pt.
For business customers the courts of Lisbon, Portugal have exclusive jurisdiction. Consumers can bring a claim in the courts that the law gives them.
